  1. Attached to the above letter was a dossier of utterances and postings on various social media platforms allegedly attributed to Mr Samuel Koku Anyidoho which are considered to be injurious to the party and are meant to drag the name, the image and reputation of the NDC into ridicule, contempt and disrepute.
  2. The National Disciplinary Committee, on receipt of the above letter and supporting documents, met and after deliberations sent the publications allegedly attributed to Mr Samuel Koku Anyidoho to him through his email and whatsapp on the 23 rd of February, 2021 and by EMS courier services on the 24 th of February, 2021.

  4. Mr Samuel Koku Anyidoho failed to acknowledge receipt of the whatsapp message (even though it was marked as delivered and read). He also ignored the email message and rejected the letter sent to him through EMS courier service indicating that “he has no idea about the letter”.
  5. Notwithstanding the above actions, the National Disciplinary Committee still invited him for a hearing on Wednesday, the 12th of May, 2021.

Invitation letter was sent to him through his email and whatsapp on the 28th of April, 2021 and by DHL courier services on the 30th of April, 2021 but he failed to
turn up.

  3. The DHL officer on second delivery attempt on the 20 th of May, 2021 reported that when he called Mr Samuel Koku Anyidoho to deliver the letter to him, he said that “he will not receive the letterfor security reasons”.

B. OBSERVATIONS

  1. From the narratives above, the National Disciplinary Committee makes the following observations:
    (a) Mr Samuel Koku Anyidoho did not respect the structures of the party and the authority of the FEC and NEC.
(b)ln a social media posting, he referred to the National Disciplinary Committee as “the so called Disciplinary Committee” which is disrespectful and unacceptable.

    (d) The conduct of Mr Samuel Koku Anyidoho is most improper and very reprehensible.

C. FINDINGS

I I . The National Disciplinary Committee therefore makes the following findings: a. Mr Samuel Koku Anyidoho repeatedly evaded service of the disciplinary processes on him. By this conduct, he made it impossible for the Committee to investigate and give him hearing.

b. Mr Samuel Koku Anyidoho’s conduct in treating the NEC’s referral of his .4conduct for disciplinary investigation is a gross disrespect to the party and its leadership.
Additionally, his continuing negative public utterances about the Party and its leadership does not present him as a remorseful member of the NDC.

c. Mr Samuel Koku Anyidoho has thrown the name of party into disrepute, ridicule and contempt.
d. Mr Samuel Koku Anyidoho’s conduct contravenes Article 47 (e) and 48
(8) (a) and (b) of the Party’s Constitution.

D. CONCLUSION

  1. Mr. Samuel Koku Anyidoho is liable for misconduct and is therefore amenable to disciplinary sanctions specified under Article 48 (9) of the party’s
    Constitution.

E. RECOMMENDATION

  1. The National Disciplinary Committee having found Mr. Samuel Koku Anyidoho liable and his conduct very reprehensive recommends his outright expulsion from the party in accordance with Article 48 (9) (a) of the party’s constitution.
